Terms and Conditions

These Terms and Conditions govern your use of the Akasha Jewelry website and purchases from Carolina Moura, trading as Akasha Jewelry.

By using the website or placing an order, you agree to these Terms. Mandatory consumer rights that cannot legally be excluded remain unaffected.

Products & Orders

2. Customer Responsibilities

You must provide accurate contact, billing, delivery and sizing information.

You are responsible for checking your order details before payment and contacting Akasha promptly if you discover an error.

You must be legally capable of entering into a purchase agreement in your country.

3. Handmade Jewelry

Akasha jewelry is handmade using natural materials.

Gemstones, pearls and metals may vary naturally in color, shape, texture, dimensions and appearance. Minor irregularities and differences between pieces can be characteristics of handmade production and do not necessarily constitute defects.

Product photography is intended to represent each piece accurately. Colors and proportions may appear differently because of lighting, photography and screen settings.

4. Prices and Currencies

Prices appear in the currency displayed on the website.

Shipping charges, taxes, customs duties and import fees may be added or collected separately where applicable.

Payment providers may apply their own exchange rates or currency-conversion fees.

Akasha may change prices at any time, but a price change will not normally affect an already accepted order.

If a price is clearly incorrect because of a genuine technical or administrative error, Akasha may contact the customer to offer the correct price or cancel and refund the order.

5. Orders

Submitting an order does not automatically mean it has been accepted.

An order is accepted after Akasha confirms it and the required payment has been successfully received or authorized.

Akasha may refuse or cancel an order before acceptance because of unavailability, payment problems, pricing errors, suspected fraud, shipping restrictions or inability to complete a requested customization.

If Akasha cancels a paid order, the applicable amount will be refunded.

Payments

6. Payments

Full payment is required before production or processing begins.

Available payment methods may include:

  • Shopify checkout.
  • PayPal.
  • Wise transfer.
  • Bank transfer.

For Wise and bank transfers:

  • Processing begins only after cleared payment is received.
  • The customer must include the requested order reference.
  • The customer is responsible for bank, intermediary and currency-conversion fees.
  • Akasha must receive the full order amount.

Installment payments are not currently offered.

Production & Bespoke Orders

7. Production and Dispatch Estimates

Ready-to-ship orders are normally dispatched within approximately one week after payment is confirmed.

Made-to-order pieces are normally dispatched within approximately five weeks after payment and the required specifications are confirmed.

These are estimates and not guarantees.

Production and dispatch may be affected by material availability, design complexity, studio capacity, illness, holidays, shipping disruption or circumstances outside Akasha’s reasonable control.

Akasha will communicate significant known delays where reasonably possible.

Delivery time begins after dispatch and depends on the carrier, destination and customs process. Estimated delivery dates are not guaranteed.

8. Bespoke and Customized Orders

A bespoke enquiry does not confirm an order.

A bespoke or customized order begins only after:

  • The design and specifications have been agreed.
  • The price and estimated timeframe have been confirmed.
  • Full payment has been received.

Changes requested after production begins may be refused or may result in additional costs and delays.

Cancellations, Refunds & Returns

9. Cancellations

Orders may be cancelled for a full refund before production begins.

Once production has begun, customized or bespoke orders may be eligible for a partial refund.

Akasha may retain an amount proportionate to the work already completed and materials already committed, up to 50% of the order value.

Cancellation requests must be sent promptly to akashaajewelry@gmail.com.

This cancellation policy does not limit withdrawal or cancellation rights that cannot legally be excluded in the customer’s country.

10. Returns and Change of Mind

Return requests must be submitted within 7 calendar days of receiving the order. Eligibility depends on the reason for return, the condition of the piece, the type of order and applicable consumer law.

Any mandatory withdrawal right available under the customer’s applicable consumer law remains unaffected.

Where such a right applies:

  • The customer may exercise it within the legally required period.
  • Akasha will refund the product price and original standard shipping charge where required.
  • The refund will be issued through the original payment method.
  • The customer must follow the provided return instructions.
  • The product must be returned unworn, undamaged and, where reasonably possible, in its original packaging.

Beyond mandatory rights, Akasha does not generally accept change-of-mind returns or exchanges for one-of-a-kind, customized, resized, made-to-order or bespoke pieces.

Any exclusion applies only where legally permitted.

11. Return Process

Before returning anything, contact akashaajewelry@gmail.com and include the order number and reason for the request.

Unauthorized returns may not be accepted.

When return shipping is the customer’s responsibility:

  • The customer must use tracked and appropriately insured shipping.
  • The customer is responsible for the return cost.
  • Risk remains with the customer until Akasha receives the parcel.

Approved refunds are issued through the original payment method, normally within 10 business days after the returned piece is received, inspected and approved.

Payment providers may require additional processing time.

Sizing & Warranty

12. Ring Sizing and Resizing

Customers are responsible for selecting or providing the correct ring size.

Sizing systems can vary, so customers should consult the Size Guide or obtain a professional measurement before ordering.

If the customer selected or provided the wrong size:

  • Akasha must be contacted within seven days of delivery.
  • The piece must be dispatched back within seven days of delivery, following Akasha’s instructions.
  • The piece must be unworn and undamaged.
  • The customer is responsible for tracked and insured return shipping.
  • The customer is responsible for redelivery costs.
  • The customer is responsible for the applicable resizing fee.
  • Resizing is subject to the design being technically suitable for alteration.

Akasha does not accept damaged pieces for ordinary resizing.

If Akasha supplied a size different from the confirmed order, Akasha will correct the error and cover reasonable return and redelivery costs.

13. Damaged, Defective or Incorrect Items

Customers should inspect their order after delivery.

If a piece arrives damaged, appears to contain a manufacturing defect or differs materially from the confirmed order, contact Akasha promptly and provide:

  • The order number or proof of purchase.
  • A description of the issue.
  • Clear photographs of the jewelry and packaging.

Do not send the piece before receiving return instructions.

If Akasha confirms that the issue resulted from a manufacturing fault or Akasha’s error, Akasha will provide an appropriate repair, recreation, refund or other legally required remedy and cover reasonable return shipping.

14. Twelve-Month Manufacturing Warranty

Akasha provides a complimentary 12-month manufacturing warranty beginning on the delivery date.

A piece confirmed to contain a manufacturing defect may be repaired, recreated or refunded by Akasha, subject to the circumstances and any mandatory consumer rights.

For a confirmed manufacturing defect, Akasha will cover reasonable return shipping according to the instructions provided.

The warranty does not cover:

  • Theft or loss.
  • Damage caused by accident, impact, misuse or improper storage.
  • Dents, abrasions or scratches caused by everyday wear.
  • Chipped, scratched, nicked or broken gemstones caused by accident or wear.
  • Damage caused by chemicals, cosmetics, perfume, chlorine, bathing or corrosive substances.
  • Pits or holes caused by exposure to corrosive chemicals.
  • Metal discoloration caused by chemical or environmental exposure.
  • Normal wear, including gradual metal wear requiring restoration.
  • Repairs or alterations performed without Akasha’s authorization.
  • Incorrect sizing information provided by the customer.

A gemstone broken by the customer through impact, accident or misuse is not considered a manufacturing defect and is not eligible for return under the warranty.

If a gemstone falls because of a confirmed manufacturing or setting fault, Akasha will repair the piece and cover reasonable return shipping.

This warranty is additional to mandatory consumer rights and does not replace them.

Shipping Policy

15. Customs and Import Charges

The customer is responsible for customs duties, import taxes, brokerage fees and local charges imposed by the destination country.

These charges are not included unless expressly stated otherwise.

Akasha cannot control customs delays or declare a commercial order as a gift.

16. Delivery

Shipping and delivery times are estimates and never guarantees.

The customer is responsible for:

  • Providing a complete and accurate delivery address.
  • Monitoring tracking information.
  • Responding to the carrier or customs authority.
  • Paying applicable import charges.
  • Being available to receive the parcel.

Additional charges may apply if a parcel is returned because of an incorrect address, refusal, unpaid customs charges or failed delivery.

Mandatory legal responsibilities concerning delivery remain unaffected.

Jewelry Care

17. Jewelry Care

Jewelry should be handled and stored carefully.

Exposure to chemicals, cosmetics, perfume, chlorine, water, pressure or impact may damage metals, settings and gemstones.

Customers should follow the Care Guide provided on the website.
